These Terms and Conditions govern the supply of goods purchased through this website. This service is operated by Barewall Ltd, a company incorporated in England and Wales (Co. No. 7314976), with its registered office at 2-4 Market Place, Burslem, Stoke-on-Trent ST6 4AT (“Barewall,” “we,” “us,” or “our”).

1. Contract Formation (Your Order)

We must receive full payment for your order before we will accept it. Once payment is received, we confirm our acceptance of your order by sending an email to the address you provided. Our acceptance of your order constitutes a legally binding contract between you and us.

2. Prices

2.1 The prices for goods are those set by Barewall at the time of your order.

2.1.1 All prices are in Great British Pounds (GB£). Any other currency displayed on the site is for comparison only. You will be billed in GB£. Purchases made from outside the UK may be subject to currency fluctuations and credit card charges, which could affect the final amount billed.

2.2 You may be required to pay additional delivery charges. Delivery may not be possible to all locations. Our delivery charges are detailed on our website. If we cannot deliver to your location, we will notify you by email and ask you to select an alternative delivery address or accept a full refund/cancel your order.

3. Cancellation by You

3.1 You may cancel your order within 7 working days of receiving the goods by contacting our Customer Services Team on 07932717718. You are not required to provide a reason for cancellation and will not incur a penalty. However, you cannot cancel orders for goods that are:

Made to your specific order or clearly personalised.
By their nature, they cannot be returned, or are liable to deteriorate or expire rapidly.
Classified as ' one-offs'.

Your statutory rights remain unaffected.

3.2 To cancel, you must notify us by email at shop@barewall.co.uk or by telephone on 07932717718 (or +44 (0) 7932717718 for overseas calls) and obtain a Returns Authorisation Code.

3.3 If you cancel your order, the sum debited from your payment card will be credited to your account as soon as possible, and in any event within 10 working days of us receiving the returned items, provided that the goods are returned to us in the same condition they were in when delivered to you. You are responsible for returning the items in their original packaging via insured recorded delivery.

4. Cancellation by Us

4.1 We reserve the right not to accept, and to cancel, any order if:

4.1.1 We have insufficient stock to fulfil the order.

4.1.2 We do not deliver to your area.

4.1.3 An item was listed at an incorrect price due to a typographical error or an error in the pricing information provided by our artists.

4.2 Should we cancel your order, we will notify you by email and re-credit your account with any sum deducted from your credit/debit card as soon as possible, and in any event within 7 working days of your order. We will not offer any compensation for disappointment.

5. Delivery

5.1 We deliver within the UK. We will deliver the goods to the delivery address you provide with your order. It is your responsibility to ensure the delivery address is correct and accurate and that someone is available to sign for and accept delivery from the courier.

5.2 All UK deliveries will be made using either Royal Mail 48 HR Tracked or another appointed suitable courier.

5.3 Sales enquiries from outside the UK must be made in writing to shop@barewall.co.uk or our registered address: 2-4 Market Place, Burslem, Stoke-on-Trent ST6 4AT England.

Delivery Charges:

UK DELIVERIES

The delivery charges are determined by our individual artists. These charges include registered/signed-for delivery for tracking purposes. Insurance of the artwork during delivery is at the artist's discretion, and it is the artist’s responsibility to recover any costs in the event of items lost or damaged in transit.

5.4 If your order is returned to us because the courier or postal service was unable to complete delivery for any reason, you will be responsible for the additional delivery costs should the goods need to be re-delivered. We will contact you upon the goods' return.

6. Governing Law and Jurisdiction

Your order is considered completed within the UK. These terms and conditions (and any related dispute, controversy, proceedings, or claims) shall be governed by and interpreted in accordance with English Law, and the English Courts shall have exclusive jurisdiction.

7. Entire Agreement

7.1 These terms and conditions, along with our current website prices, delivery details, contact details, and privacy policy, constitute the entire agreement regarding the supply of goods to you by us. No statement made by any salesperson on our behalf should be construed as a variation of these terms or as an authorised representation about the nature or quality of the goods. Except for fraudulent misrepresentation, we accept no liability for any such representation being untrue or misleading.

7.2 We offer no representations or warranties regarding the accuracy, completeness, or suitability for any purpose of the information and related graphics published on our website. Our site may occasionally contain technical inaccuracies or typographical errors.

8. Trade Marks and Copyright

We are the operator of www.barewall.co.uk. All trademarks, product names, company names, or logos cited herein are the property of their respective owners. We grant no permission for the use of any such brand names, photographs, product names, titles, or copyrights, and such use may infringe upon the owners’ rights.

9. Events Beyond Our Control (Force Majeure)

We will not be in breach of these terms and conditions, or otherwise liable for any delay or failure in performance, if the delay or failure is caused by circumstances beyond our reasonable control. This includes, without limitation, strikes, lockouts, and other industrial disputes, breakdown of systems or network access, flood, fire, explosion, or accident.
