Terms and Conditions for the supply of goods through this website. This service is operated by Barewall Ltd (Incorporated in England and Wales, Co. No. 7314976) whose registered office is at 2-4 Market Place, Burslem, Stoke-on-Trent ST6 4AT ( “barewall”, “we”, “us” or “our”).

Your Order

We must receive payment in full for your order before your order will be accepted by us. Once we have accepted your order and payment has been received we will confirm our acceptance of your order by sending you an email to the email address provided in your order form. Our acceptance of your order creates a legally binding contract between you and us.

2. Prices

2.1 The prices payable for goods that you order are as set out by Barewall at the time of your order.

2.1.1 All of our prices are GB£ - any other currency displayed on the site is for comparison only. You will be billed in GB£. If you purchase from outside the UK, currency fluctuations and credit card charges may make a difference to the amount billed to your credit/debit card.

2.2 You may be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Our delivery charges are set out in our website. If we are unable to deliver to your location we will notify you of this by email and invite you to chose a different delivery location [or accept a full refund/cancel your order].

3. Cancellation by you

3.1 Should you wish to cancel you must do so within 7 working days from receiving the order by contacting our Customer Services Team on 01782 258843. You do not need to give us any reason for cancelling your order nor will you have to pay any penalty. However, you may not cancel your order if the goods ordered are made to your specifications or are clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly or are one offs. Your statutory right is not effected.

 

3.2 To cancel your order you must notify us by email at shop@barewall.co.uk or telephone us on 01782 258843 or for overseas calls +44 (0) 1782 258843 and obtain a Returns Authorisation Code.

3.3 If you have notified us that you are cancelling your order, the sum debited from your payment card will be credited to your account as soon as possible and in any event within 10 working days of receiving the returned items PROVIDED THAT the goods in question are received by us in the condition they were in when delivered to you. You are responsible for the return of the items in the packaging that they were delivered to you in and for the return by insured recorded delivery.

4. Cancellation by us

4.1 We will not accept and reserve the right to cancel any order between you and us if:

4.1.1 we have insufficient stock to deliver the goods you have ordered;

4.1.2 we do not deliver to your area; or

4.1.3 one or more of the items you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our artists.

4.2 If we do cancel your order we will notify you by email and will re-credit to your account any sum deducted by us from your credit/debit card as soon as possible but in any event within 7 working days of your order. We will not offer any compensation for disappointment.

5. Delivery to you

5.1 We deliver within the UK and we will deliver the goods ordered by you to the address you give us for delivery when you make your order. It is your responsibility to ensure that the delivery address is correct and accurate and that there will be somebody to sign for and take delivery of the goods from the delivery service.

 

5.2 All UK deliveries will be made using either Royal Mail Special Delivery or our appointed courier.

5.3 Any sales enquiries from outside of the UK must be done in writing to shop@barewall.co.uk or our registered address, 2-4 Market Place, Burslem, Stoke-on-Trent ST6 4AT England.

Delivery Charges:

UK DELIVERIES

The delivery charges are set by our individual artists. The delivery charges include registered/signed for delivery for tracking purposes. Insurance of the artwork during the delivery is at the discretion of the artist and it is the artists responsibility to recover any costs in the event of items lost or damaged during transit.

5.4 If your order is returned to us because the courier or postal service could not complete delivery to you for whatever reason, you will be responsible for the additional delivery costs if the goods are re-delivered. We will contact you on the return of the goods to us by the courier

6. Governing Law

Your order is deemed to be completed within the UK and shall be governed by and interpreted in accordance with English Law. These terms and conditions (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and 4.1 Interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction in relation thereto.

7. Entire Agreement

7.1 These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

 

7.2 We make no representations or warranties about the accuracy completeness or suitability for any purpose of the information and related graphics published on our website. From time to time our site may contain technical inaccuracies or typographical errors.

8. Trade Marks and Copyright

We are the operator of www.barewall.co.uk All trademarks, product names and company names or logos sited herein are the property of their respective owners. No permission is given by us in respect of the use of any such brand names, photographs, product names or titles or copyrights and such use may constitute an infringement of the owners’ rights.

 

9. Events beyond our control

We will not be in breach of these terms and conditions or otherwise liable for any delay in performance if the delay or failure is due to circumstances beyond our reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
